1. General Purchase Rules
1.1. The Purchase Rules (hereinafter referred to as the Rules) are a legal document binding on the Parties, which determines the rights, duties and responsibilities of the Buyer and the Seller in the purchase of goods and services at UAB Gymplius, legal entity code 303064057, registration address: 25, Vilniaus st. 25, Vilnius.
1.2 The Buyer hereby agrees to these Rules before making payment.
1.3. The Seller shall have the right to change, amend or supplement the Rules at any time. The Buyer shall be informed of the changes on the website. The Rules in force at the time of placing the order shall apply to the Customer’s purchase at www.gymplius.lt.
1.4. The Buyer shall have the right to consult the prices of gym memberships sold in the online store.
1.5. Purchases of Goods/Services shall be restricted to persons aged 18 years and over. By making a purchase, the Buyer hereby confirms that he/she is at least 18 years of age or has obtained the consent of a parent or legal guardian who is at least 18 years of age and has accepted these Rules on his/her behalf.
1.6. When purchasing services/goods, the Buyer must provide correct personal details of the Buyer: name, surname, e-mail address, date of birth and telephone number. In the event of a change in the data provided by the Buyer, the Buyer must immediately inform the Seller thereof. By confirming an order for services/goods, the Buyer undertakes to verify that all the data entered by the Buyer is correct.
1.7. The account number must be entered with the monthly payment when the contract is concluded. After payment, the Buyer’s bank account number will be included in the online invoice contract. The services are available to banks operating in Lithuania: Swedbank, SEB, Luminor, Citadele, Šiaulių bankas, Medicinos bankas. The account number can be changed at a later date upon sending a request to: info@gymplius.lt
2. Settlement
When paying for the goods, you will be redirected to the system of payment institution UAB OPAY solutions, where you can choose the desired payment method.
2.1. Payment by electronic banking means payment using the electronic banking system used by the Buyer. In order to use this form of payment, the Buyer must have signed an electronic banking agreement with one of the banks operating in the Republic of Lithuania: Swedbank, SEB, Luminor, Citadele, Šiaulių bankas, Medicinos bankas. When paying in this way, OPAY generates a basket according to which the payment is made. When paying for goods or services on www.gymplius.lt, the funds will be credited to the bank account of the paying institution UAB OPAY solutions. A unique basket is generated each time you make a payment, so transactions that are made using a re-used basket are not counted.
2.3 Payments via electronic banking – instant payments initiated through the intermediary of AB NEO Finance and UAB OPAY. At the time of settlement, a payment shall be initiated in the name of the buyer at the financial institution of his/her choice and needs to be confirmed. This type of payment shall be used to pay with Revolut and Paysera accounts. A unique basket is generated each time you make a payment, so transactions that are made using a re-used basket are not counted.
2.2. Payment by payment card shall mean prepayment using a credit, debit or virtual card held by the Buyer. For this payment method, the payment institution UAB OPAY solutions shall generate a payment for the Buyer according to the order to be paid by him/her. Then the details of your card must be filled in, i.e. the name and surname of the cardholder, card number, expiry date and the three-digit security code (CVV).
IMPORTANT! Card payments are only accepted if the Buyer’s card-issuing bank participates in secure online payment programmes (MasterCard SecureCode or Verified by Visa). Once the card details have been entered, the Buyer may be redirected to the card-issuing bank’s website to enter the security code required to verify their personal identity. If the payment is not confirmed, please contact the issuing bank or choose another payment method.

3D Secure Authentication will be applied to card payments across the EU from 1 April 2022, ensuring the security of payments. 3D Secure (3-domain structure) Authentication, also known as Payer Authentication, is a security protocol intended to help prevent fraud in online credit and debit card transactions. This allows banks to request additional information from the cardholder in order to verify the purchase. If you receive the error “3D authentication failed”, this means that you have not successfully entered the required information.
3. Refunds
3.1. Money for the goods shall be refunded to the Buyer in the same way as the Buyer paid for the goods at the time of purchase, unless the Buyer and the Seller agree otherwise. The Buyer shall in all cases have the right to have the money refunded to the bank account specified by the Buyer. The money shall be refunded to the Buyer within 20 business days.
3.2. Refunds shall not be issued once the service has been used, the customer has a fixed-term purchase contract, regardless of whether they use the service, except in exceptional cases agreed upon in advance with the management.
4. Seller’s rights
4.1 The Seller shall have the right, at its sole discretion, to set a minimum Order size, i.e. a minimum amount above which free delivery of the Buyer’s Order will be made. This amount shall be specified in the Seller’s delivery conditions.
4.2 If the Buyer attempts to undermine the stability and security of the operation of the Online Shop or breaches his/her obligations, the Seller shall be entitled to restrict or suspend the Buyer’s access to the Online Shop immediately and without notice.
5. Obligations of the Seller
5.1 The Seller undertakes to enable the Buyer to use the services of the Online Shop on the terms and conditions set out in these Conditions and in the Online Shop.
5.2 The Seller undertakes to respect the Buyer’s right to privacy of personal information belonging to him and to process the personal data provided by the Buyer only in accordance with the procedure set out in Section 12 of the Terms and Conditions and the legislation of the Republic of Lithuania.
5.3 The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer in accordance with the conditions set out in Section 9 of the Rules.
5.4 If the Seller, due to important circumstances, is unable to deliver the goods ordered to the Buyer, the Seller undertakes to refund to the Buyer the money paid, if prepayment has been made.
5.5 If the Buyer exercises the right provided for in Clause 4.2 of the Rules and the condition provided for in Clause 4.4 of the Rules, the Seller undertakes to reimburse the Buyer within 30 (thirty) days from the date of receipt of the returned goods.
6. Procedure and terms of payment of goods:
6.1 When paying for the Goods, you will be redirected to the system of the payment institution UAB OPAY solutions, where you will be able to choose the desired method of payment.
6.2 Payment by electronic banking means payment by means of the electronic banking system used by the Buyer. 7. Delivery of goods
7.1 The ordered goods shall be delivered to the OMNIVA post office of your choice. The nearest post office can be selected at the time of ordering the goods. It is not possible to change the delivery location after ordering.
7.2 Delivery of the Goods to the Buyer:
7.2.1 The Buyer undertakes to specify the exact place of delivery of the Goods by selecting the delivery service at the time of ordering.
7.2.2 The parcel must be collected from the Omniva post office within 7 (seven) calendar days after the Seller has informed the Buyer by email that the goods are available for collection, unless otherwise stated in the email.
7.2.3 Where the Buyer wishes the Goods to be delivered outside Lithuania, the terms of delivery of the Order shall be agreed by separate agreement.
7.3 If the Buyer places an Order before 16:00 on weekdays and payment is made, the Seller or its authorised representative shall deliver the Goods within 5 working days from the date of payment appearing on the invoice. In the event of any failure or shortage of the Goods, the Seller shall promptly notify the Buyer of the possibility of a longer delivery period and, if the Buyer is satisfied, the Seller shall proceed with delivery of the Order.
7.4 In all cases, the Seller shall be exempt from liability for breach of the time limits for delivery of the Goods if the Goods are not delivered to the Buyer or are not delivered on time due to the Buyer’s fault or due to circumstances beyond the Buyer’s control.
8. Guarantee of the quality of the goods and the period of fitness for use
8.1 The characteristics of each of the Seller’s Goods shall be set out in general terms in the description of the Goods accompanying each Good.
8.2 The Seller shall not be liable for the fact that the colour, shape or any other parameter of the Goods in the Online Shop may not correspond to the actual size, shape and colour of the Goods due to the characteristics of the display used by the Buyer.
9. Return and exchange of good
9.1 The defects of the sold goods shall be eliminated, the defective goods shall be exchanged and returned in accordance with the Rules for Return and Exchange of Goods approved by the Minister of Economy of the Republic of Lithuania by the Order of the Minister of Economy of the Republic of Lithuania No. 217 dated 29 June 2001 “On the Approval of the Rules of the Return and Exchange of Goods”.
9.2 In order to return the item(s) in the cases referred to in Clause 11.1 of the Rules, the Buyer shall contact the Seller and submit a written request for the return of the goods. This must be done in accordance with Clause 4.2 of the Conditions.
9.3 The Buyer must comply with the following conditions when returning the Goods:
9.3.1 The returned goods must be in their original packaging in good working order (this clause does not apply in the case of returns of low quality goods);
9.3.2 The Goods must be undamaged by the Buyer;
9.3.3 The Goods must be unused and in good condition (labels intact, protective film intact, etc.) (this clause does not apply in the case of a return of low-quality Goods);
9.3.4 The returned Goods must be in the same condition as when received by the Buyer (including packaging, if any);
9.3.5 When returning the Goods, the document of purchase and a written request for return must be provided.
9.4 The Seller shall have the right not to accept the Buyer’s return of the Goods if the Buyer fails to comply with the return procedure set out in this Article.
9.5 Returns and exchanges of goods shall be carried out in accordance with the “Rules for Returns and Exchanges of Goods” approved by Order No 217 of the Minister of Economy of 29 June 2001 and the “Rules for the Sale of Goods and Provision of Services when Contracts are Concluded by means of Communication” approved by Order No 258 of the Minister of Economy of 17 August 2001.
9.6 In all cases, money for returned goods shall be transferred by payment order and only to the payer’s bank account.
10. Final provisions
10.1 These Rules are drawn up in accordance with the legislation of the Republic of Lithuania.
10.2 The relations arising from these Rules shall be governed by the law of the Republic of Lithuania.
10.3 Any disagreements arising from the execution of these Rules shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
11. Disputes
Disputes regarding improper performance or non-performance of the Contract shall be settled out of court in accordance with the procedure established by the Law on Consumer Rights Protection of the Republic of Lithuania, at the State Consumer Rights Protection Service, Vilniaus g. 25, 01402 Vilnius, e-mail: tarnyba@vvtat.lt, telephone (8 5) 262 67 51, website: www.vvtat.lt.
